Introduction

The SEND Forums (comprising The SENCO Forum, The SLD Forum and The SEND & ICT Forum) are operated by nasen, the Data Controller. As controller of your personal data, nasen is responsible for how your data is collected, stored, processed and destroyed.

nasen is a charitable organisation (reg Charity number 1007023) supporting practitioners by providing relevant information, training and resources to enable staff to meet all pupils’ needs. Working with dedicated education professionals, nasen aims to ensure that practice for special and additional needs is both effective and current.

nasen is committed to providing an excellent range of professional development opportunities by offering the latest news and information, to support practitioners in identifying and meeting the needs of children and young people.

The National Association of Special Educational Needs (nasen) is a company limited by guarantee (Reg. Co. number 2674379). It carries on a range of activities to generate income for nasen including membership, training conferences and event, publications and online research journals.

Information we collect

As a Community Member, when you participate in The SEND Forums (including The SENCO Forum, The SLD Forum and The SEND & ICT Forum), we collect the following information relating to you and your use of our services from a variety of sources:

Registration information

We store information you provide when you register for an account in the community, including name and email address.

Profile data

We store profile information that you choose to share in your Community Member profile. For example, your profile picture, tagline, website URL, and bio.

Community content

We store content that you post in the community. For example, topics, articles, ideas, images, files, questions, and replies.

Usage data

We collect usage data about Community Members whenever they interact with our services.

Device and browser data

We collect data about the device and application you use to access our Service, such as the IP address, browser type, and operating system. We may also infer the geographic location based on the IP address.

Log data

Like most websites today, our web servers keep log files that record data each time a device accesses those servers. The log files contain data about the nature of each access, including originating IP addresses, internet service providers, the files viewed on our site (e.g., HTML pages, graphics, etc.), operating system versions, device type and timestamps.

Information from cookies and page tags

Forumbee uses third party tracking services that employ cookies and page tags (also known as web beacons) to collect aggregated and anonymized data about visitors to our websites. This data may include usage and user statistics. You can obtain full information about our cookie policy here.

 

Purposes of the processing

We use the information we collect from you to perform the services requested in connection with The SEND Forums platform.

We also use your information to review, investigate and analyse how to improve the services provided. We may also collect and analyse your data to monitor, maintain and improve our services and features.

We may internally perform statistical and other analysis on information we collect (technical and metadata) to analyse and measure user behavior and trends, to understand how people use our services, in order to improve and optimise our performance of such services, and to monitor, troubleshoot and improve our services, including to help us evaluate or devise new features.

We may use your information for internal purposes designed to keep our services secure and operational, such as testing purposes, troubleshooting, to prevent abusive activity (i.e. fraud, spam, phishing activities), and for service improvement, research and development purposes.

We use log data for many different business purposes to include:

o   To monitor abuse and troubleshoot.

o   To create new services, features, content or make recommendations.

o   To track behavior at the aggregate/anonymous level to identify and understand trends in the various interactions with our services.

o   To fix bugs and troubleshoot product functionality.

o   Your IP address is used to determine where an unknown/unauthorized access may have occurred in your account (abuse monitoring).

We shall not sell, transfer or lease out your personal data to third parties. We share your information with our service provider, Forumbee LLC (the Data Processor) who help us to provide our services to you, in which case those third parties are required to comply with our Privacy Policy and any other adequate technical and organizational measures. We contractually bind these service providers by the corresponding Data Processing Agreements to keep your information confidential and to use it only for the purpose of providing their services and pursuant to the applicable privacy legislation in the EU.

Your data is not disclosed to any third party except (i) for providing the services you requested and for which Forumbee collaborates with third parties, (ii) when we have your permission, (iii) when it is required by a competent authority in the exercise of its duties (for example in order to investigate, prevent or take action regarding illegal activities) or (iv) as otherwise required by law.

We do not use your data other than as described in this Privacy Policy and the Terms of Use.

 

The lawful basis for the processing

Under the EU General Data Protection Regulation (2016) and The UK Data Protection Act (2018), we undertake to process all personal data lawfully, fairly and in a transparent manner. The basis of this undertaking is your explicit consent provided during the registration/sign-up process.

Transfer of personal data outside of the EU

As The SEND Forums is a cloud-based platform, the information which you provide to us may be transferred to countries outside the European Union (EU) for the purposes of data processing activities.

These countries may not have similar data protection laws to the UK. By submitting your personal data, you’re agreeing to this transfer, storing or processing. If we transfer your information outside of the EU in this way, we will take steps to ensure that appropriate security measures are taken with the aim of protecting your privacy rights as outlined in this policy.

 

Data retention period

Nasen undertakes to preserve personal data and community content for a period of five years, from the establishment of the SEND Forum account.

 

Your rights

Under the EU General Data Protection Regulation (2016) and The UK Data Protection Act (2018) you have the following rights in regard to your personal data:

o   the right to be informed about the collection and use of your personal data

o   the right of access to your personal data

o   the right to have inaccurate personal data rectified, or completed if it is incomplete

o   the right to have personal data erased

o   the right to request the restriction or suppression of personal data

o   the right to obtain personal data in portable formats

o   the right to request any data created as a result of automated decision-making
